Welcome: How to Use These Terms & Conditions

Planning a journey should feel exciting, not overwhelming. These Terms & Conditions outline how bookings with Modern Adventure work, including payment timelines, what’s included, what’s not, and how changes or cancellations are handled. Our goal is to be clear, fair, and consistent with how we operate: collaboratively, with care for our guests, our tastemakers, and our local partners.If you have questions or need help with a specific booking, please contact us at support@modernadventure.com or +1 (855) 219-8018.

This document outlines the terms and conditions for booking a travel experience with Modern Adventure, LLC (“Modern Adventure”, “MO/AD”). Please read these terms carefully before confirming your booking.

1. Agreement

The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the trip “Participant” and Modern Adventure, LLC (“Modern Adventure”) with respect to any and all bookings, tours, or transactions made with Modern Adventure through any of its online platforms including but not limited to MO/AD Retreats, MO/AD Private Departures and modernadventure.com.

2. Acceptance of Terms

By making a booking with Modern Adventure, you accept all of the terms in this agreement and authorize us to perform services on your behalf. All persons named in this booking (“Participants”) are subject to this agreement. By making a booking, you affirm that you have made all other Participants listed in the booking aware of these terms and that all Participants accept these terms, regardless of who makes payment.

3. Payment and Booking Acceptance

• Currency: All payments must be made in United States dollars (USD).
• Payment Methods: We accept ACH & bank transfers, and major credit cards (Visa, MasterCard, Discover, American Express) without any extra fees. Your payment statement will show “Modern Adventure” or “Modern Adventure LLC.”
• Booking Confirmation: Your booking is confirmed once you receive a confirmation email from Modern Adventure. We recommend booking early as space is limited.
• Right to Decline: We reserve the right to decline any booking for any legitimate reason as outlined in this agreement.

4. Travel Insurance

Travel insurance is not included in your trip cost and is an essential part of traveling with Modern Adventure. Because our trips involve advance, non-refundable commitments and in destinations where medical care, evacuation, or travel disruptions are your responsibility, we strongly recommend that all Participants carry comprehensive travel insurance.

Your policy should include coverage for trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you.

If you cancel your trip, or Modern Adventure cancels, reschedules, or modifies a trip, travel insurance is the primary means of protection for costs not otherwise refundable under these Terms & Conditions. You also agree to assume all costs of medical care, evacuation, transportation, and related costs. Modern Adventure is not responsible for losses that may be covered by insurance.

By booking, you acknowledge responsibility for obtaining adequate coverage.

Additional Expenses

Modern Adventure is not responsible for costs incurred in preparing for travel (e.g., flights, visas, equipment) or arrangements made independently. We recommend purchasing refundable airfare, and any additional incurred expenses should be covered by your trip interruption and cancellation travel insurance. The term applies whether the tour is altered, modified, or canceled by us or by you for any reason

5. Traveler Code

By making a booking, you certify your agreement to the following Traveler Code:

• Right Fit: You have selected a trip that matches your abilities, fitness level, and health, and you are able to participate safely in the activities described.
Personal Responsibility & Mobility Requirements: You are responsible for managing your own mobility and participation. These trips are not suitable for individuals who require physical mobility assistance or personal care. Modern Adventure staff, guides, and partners cannot provide physical assistance of any kind and are not responsible if you are unable to participate in some or all activities.
Medical & Dietary Needs: You will share any relevant medical conditions, mobility limitations, and dietary restrictions as early as possible, and at least 30 days prior to departure. We will make reasonable efforts to accommodate requests, but cannot guarantee that all requests can be met.
Travel Documents: You are responsible for having valid passports, visas, permits, and any required vaccinations or entry documents.
Respect & Conduct: You will respect local laws and customs, as well as the rights and privacy of fellow travelers.
Remote Travel Realities: You understand that access to medical facilities and evacuation services may be limited in some destinations.
Safety & Group Well-Being: Modern Adventure may, in its sole discretion, refuse service or remove a Participant whose health or conduct poses a risk to themselves or others, or materially impacts the experience of the group.

6. Trip Deposits & Payment Schedule

6a. Group Departures

To reserve your place on a group departure, a US $1,500 per person Trip Deposit / Booking Reservation is required at booking (unless a higher deposit is specified for a particular trip).

Standard Payment Schedule

At booking: US $1,500 per person deposit, plus single supplement costs if applicable
180 days before trip start date: 50% of the total trip cost due (inclusive of deposit paid)
120 days before your trip start date: 100% full remaining balance due
Within 120 days of departure: Full payment due at booking. If you elect to pay a deposit online, full payment is due within 10 days.

Non-Refundable Booking Deposit

A US $1,500 per person Non-Refundable Booking Deposit is required at the time of booking to reserve your place on a Modern Adventure departure.

This deposit confirms your participation, removes a limited guest space from availability, and allows Modern Adventure to make advance, non-recoverable commitments to local partners, accommodations, internal flights, experiences and guides etc. Accordingly, the Booking Deposit is non-refundable if you cancel for any reason and is applied to unrecoverable costs including those above, service fees, and payment processing fees (See Customer Cancellations & Refunds below).

Single Room Supplements

If you request a private room, the applicable single room supplement must be paid must be paid at booking to reserve that room, subject to availability.

6b. Retreats, Private, & Custom Departures

MO/AD Retreats

A non-refundable deposit of 25% of the total trip cost is required to confirm availability and secure arrangements. The final balance is due between 180 and 90 days before travel. Specific payment terms will be provided at booking.

Private & Custom Departures

A non-refundable US $500 planning deposit is required to begin proposal work and is applied toward your final trip cost. Once your proposal is accepted, a non-refundable 25% deposit is required to confirm your booking. Remaining payments are due according to the schedule below.

• Request for planning: $500 non-refundable fee
• 180+ days before departure: 25% of total trip price
• 130 days before departure: 50% of total trip price
• 90 days or  before departure: 100% of total trip price

6c.  Higher Deposits

Some trips may require a higher deposit amount or modified payment schedules. If applicable, this will be clearly disclosed at the time of booking.

6d. Payment Deadline

If payment is not received when due, Modern Adventure reserves the right to cancel your Trip Deposit / Booking Reservation, and to apply cancellation fees in accordance with the standard policy.

7. Customer Cancellations, Changes, & Refunds

How to Cancel

To cancel your Booking Reservation or Trip Deposit, please email us at support@modernadventure.com or call us toll-free at +1 (855) 219-8018 with your complete booking details. Cancellation timing is based on when we receive written notice.

Cancellation Policies

Cancellation fees are based on when we receive your written notification. Cancellation fees are based on the following schedule:

7a. Group Departures

• 151+ days before departure: $1500 per person deposit
• 150 – 121 days before departure: 50% of the total trip price
• 120 days or less before departure: 100% of the total trip price

Advance Bookings on Group Departures

If you are advance-booking a place on a group departure, prior to the trip being available on the Modern Adventure website, you will have 7 days from the trip being live to cancel your booking. We will notify you with a link to your trip overview, including itinerary and pricing, when the trip is announced. You will have seven (7) days from that notification to review the details and inform us of your cancellation.

If you choose not to proceed within the 7-day window, you may receive a full refund of payments made, less a 3% processing cost to cover non-refundable transaction fees incurred on your behalf.

After the 7-day review window, the standard Terms & Conditions apply. If we do not receive communication from you, the booking will be assumed confirmed, and your deposit will become non-refundable per our standard terms & conditions.

7b. Private & Custom Departures

• 121+ days before departure: 25% of total trip price
• 120-91 days before departure: 50% of total trip price
• 90 days or less before departure: 100% of total trip price

Trip Price Definition

“Total trip price” includes the base trip cost, single supplements, pre/post accommodations booked through Modern Adventure, and any fees or discounts tied to your confirmed booking.

Booking Transfers

At our discretion, we may allow a one-time transfer of your group departure booking to a new departure date, subject to availability, provided your request is made more than 180 days before the original trip start date. Within 180 days of departure, date changes are generally not possible due to minimum group requirements and non refundable booking costs. If you have a concern, contact us – when changes do not create added costs, we will do our best to work with you in good faith to make accommodations when possible.

Refund Process

We will process any applicable refunds using the same payment method you used for the original Booking or Trip Deposit / Booking Reservation.

No Refund for Unused Portions

Once the trip has started, no refunds will be provided for any reason for unused portion of a trip, including if you leave a trip early or are asked to leave. The trip price is a package cost and refunds and credits are not available for services not used.

No Exceptions and Insurance

There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this and other reasons, we encourage you to purchase comprehensive trip cancellation and interruption insurance and travel protection (i.e., travel medical insurance and emergency evacuation services).

8. Cancellations or Changes by Modern Adventure

Right to Cancel or Modify

Modern Adventure reserves the right to refuse, block, cancel or modify a Booking or Trip Deposit / Booking Reservation at any time, for any reason, at its sole discretion. Modern Adventure reserves the right to cancel, alter, or modify a trip prior to departure for any reason, including insufficient Participant reservations or reasons beyond our control.

Substitutions

Modern Adventure and its suppliers reserve the right to substitute hotels, restaurants, routes or other services listed in the itinerary with comparable services if necessary and in order to operate the trip smoothly.

Foreseeable Cancellations

If a trip is canceled for foreseeable reasons such as low enrollment, a refund of payments made to Modern Adventure will constitute full settlement of any claims against Modern Adventure and related parties. Modern Adventure will endeavour to confirm its departures at 130 days prior to travel. If we cancel your departure for forseeable reasons, we’ll work with you to explore the following options:

• Transferring your booking to a different departure
• Transferring your booking to trip credit to be used for a future booking
• Converting your travel to a private departure (additional costs may apply)
• Refunding your booking to the original payment method

Unforeseen Circumstances (Force Majeure)

Modern Adventure is not liable for delays or failure to perform all elements of an itinerary, resulting from Force Majeure circumstances beyond our reasonable control. In the rare event that Modern Adventure is forced to cancel or reschedule a trip for any unforeseen circumstance beyond the reasonable control of Modern Adventure, such as, but not limited to, acts of nature, war, labor strikes, earthquake, flooding, pandemics, quarantines, international travel restrictions, national emergencies, etc., Modern Adventure will reschedule your trip departure, and your booking will automatically transfer to the rescheduled date. If you are unable to travel on the rescheduled date, you may keep 100% of your booking value as a Trip Credit, valid for 24 months of the issuance date. Otherwise, if you elect to cancel your booking, our standard terms and conditions will apply.

Trip Confirmation

Modern Adventure confirms group departures approximately 130 days prior to travel. Our small-group trips are priced to operate with a minimum of ten (10) paid guests. In the event of cancellations or lower-than-expected enrollment, we will work closely with you to explore available options, which may include a small group supplement, rescheduling, trip credit, or refund in accordance with these Terms & Conditions. Because certain travel arrangements such as flights or independent accommodations are booked separately from your Modern Adventure experience, we strongly recommend comprehensive travel insurance to protect against costs that fall outside of our group program.

9. Pricing, Inclusions & Exclusions

Trip Price

The trip price is in U.S. dollars, based on double occupancy, unless otherwise stated.

What’s Included

The trip price includes services specified in the itinerary, such as specified meals, accommodations, admission fees, and guided activities as stated.

What’s Not Included

Unless specifically stated in your itinerary, trip prices do not include:
• Flights to and from the trip start and end points.
• Transportation not listed in the itinerary.
• Meals and services not listed as included.
• Personal expenses during leisure time (e.g., entrance fees, meals, drinks).
• Passports, visas and other required travel documents.
• Travel insurance, medical coverage, and evacuation services
• Airport fees, country taxes, or other local charges
• Other personal expenses
• Gratuities

Inclusions vary by trip. Your trip itinerary and pre-departure materials are the best source for what is included in your trip.

Price Changes

We aim to price trips fairly and transparently, but like most travel companies, pricing can change based on demand, seasonality, and availability.

• Unless otherwise specified, prices do not include local entry and exit taxes (such as foreign departure taxes, port charges, customs/immigration fees, and similar charges).
• Trip prices are subject to change without notice until your booking is confirmed.
• Different Participants on the same trip may have paid different prices depending on booking timing or promotions available at the time.
• Discounts or reduced pricing that become available after you book will not apply retroactively. If you choose to cancel and rebook, cancellation terms apply.

Small Group Supplement

Group trip pricing is based on a minimum of ten (10) paid guests. In some cases, a departure may be viable to operate with nine (9) or fewer guests (a “Small Group”). To maintain the full quality of the experience, Modern Adventure may offer guests the option to apply a Small Group Supplement (“SGS”) to guarantee the trip operates.

• If offered, guests may choose whether to opt in, and the number of committed guests will determine the confirmation of the departure
• Guests who travel on a trip with a SGS, will receive a US $500 trip credit per person toward a future Modern Adventure departure.
• If the group does not opt in, the trip may be canceled, rescheduled or guests offered the option to transfer to an additional departure.
• If the group numbers later reaches ten (10) or more paid guests after an SGS has been paid, any SGS amounts paid will be refunded in full.

Responsibility

Modern Adventure acts as an intermediary for independent suppliers providing lodging, transportation, meals, and activities (“Suppliers”). Suppliers are independent contractors and are not controlled by Modern Adventure. Supplier services may be subject to their own terms and the laws of the destination.

10. Trip Credits

Trip Credits may be offered at Modern Adventure’s sole discrention and can be redeemed for future Modern Adventure bookings on or before the expiration date. If you book using a trip credit, you are responsible for the remaining balance in accordance with our standard payment terms.

Trip Credit Terms

• Trip Credits are non-refundable and non-transferrable.
• Trip Credits have no cash value and cannot be exchanged for money.
• Trip Credits cannot be used after the expiration date.
• Trip Credits are the property of Modern Adventure and cannot be bought or sold.

Discretion and Disputes

Modern Adventure reserves its right to refuse, void, cancel, reject or hold for review your Trip Credit, for any reason at its discretion. If for any reason you believe that there is a discrepancy regarding your Trip Credit, please contact us. Modern Adventure may require you to submit additional information to resolve the issue.

Acceptance of Trip Credits

By accepting a Trip Credit you are agreeing that the Trip Credit is in lieu of any refund you might be entitled to receive in connection with canceling the Booking or Trip Deposit / Booking Reservation. You release Modern Adventure from any and all claims and liabilities, without limitation, relating to the Booking or Trip Deposit / Booking Reservation, and/or any refund or compensation you might be entitled to in relation to canceling the Booking or Trip Deposit / Booking Reservation.

11. Health & Wellness Policy

Your health and well-being matter. If you test positive for COVID-19 or experience symptoms of a contagious illness during your trip, we may ask you to take steps to protect yourself and the group, including temporarily refraining from group activities until you test negative or are medically cleared. We will assist you in accessing local care and making alternative arrangements where possible. However, we cannot refund missed activities or unused services due to illness. Any costs for care, testing, or additional accommodations are your responsibility or should be covered by your travel insurance.

12. Privacy

We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Notice.

13. Credit Card Authorization for Post-Booking Charges

You authorize Modern Adventure to charge your credit card for any cancellation fees or supplemental payments that you incur post-booking.

14. Force Majeure

Modern Adventure will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Modern Adventure, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.

15. Pre-Departure Documentation

Please carefully read all trip-related documents that you receive from us by email as soon as you receive them, including the Traveler Information form. It is your responsibility to inform us of any inaccuracies within thirty (30) days of receiving the documents. We cannot accept liability if you fail to notify us of any errors within this timeframe.

16. Passports and Visas

You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

17. Health Requirements and Medical Care

Our trips involve varying levels of physical activity. By booking, you represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the trip. You must inform us of any physical conditions, dietary restrictions, or other conditions that require special attention at the time of booking. Modern Adventure will use reasonable efforts to accommodate your requests. Modern Adventure is not liable for additional costs associated with accommodations for services not included in the itinerary (such as additional transportation or meal costs). We reserve the right in our sole discretion to accept, decline, or remove anyone from a trip (at departure or during the trip) who we judge to be incapable of meeting the trip’s physical demands.

18. Complaint Procedure

If you have a complaint during your trip, you must immediately notify Modern Adventure or your trip leader/host of the problem so that they can attempt to remedy the situation and allow you to enjoy the remainder of your trip. While we aim for your satisfaction, your notice to Modern Adventure or its suppliers of a complaint does not mean that we will accept liability or responsibility, and we will evaluate each complaint as it arises. Failure to raise a concern or complaint while you are on the trip will extinguish or reduce any ability to claim recourse from Modern Adventure or its suppliers. If you attempt to address the problem independently without using this notice procedure, you assume responsibility for any additional costs you may incur and forfeit any potential remedy. If you are not satisfied after using this notice procedure, you must submit your complaint in writing to Modern Adventure or its in-country supplier within fourteen (14) days of the trip’s end date. However, Modern Adventure and its suppliers will not accept any liability for claims received after the fourteen day period.

19. Trip Start Date

It is your responsibility to be ready to begin your trip as outlined in the itinerary. Modern Adventure is not responsible for any losses due to canceled or missed flights, changes in flight schedules, late arrivals, or early departures.

20. Trip Safety and Trip Etiquette

You must strictly adhere to all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of Modern Adventure, the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the trip, Modern Adventure or the local guide or supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.

21. Your Liability

You agree to defend and indemnify Modern Adventure and all of its respective owners, members, officers, directors, employees, agents, and successors and assigns from and against any claims, causes of action, demands, suits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs and any other liabilities of any kind or nature including but not limited to reasonable legal and accounting fees, arising out of or related to:

• Your breach of this Agreement or the documents referenced herein;
• Your violation of any law, rule, regulation or guideline;
• Your violation, infringement or misappropriation of the rights of a third party, including without limitation any rights of publicity or privacy;
• Your use of this Website;
• Your booking or use of any Products obtained through this Website; or
• Your negligence or willful misconduct.

22. Images Release

You agree that Modern Adventure and its contractors and suppliers may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides, staff, contractors and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing at the start of the tour.

23. Limitation of Remedies

YOU AGREE THAT THE SOLE REMEDY FOR ANY DEFAULT BY MODERN ADVENTURE LLC ARISING UNDER THIS AGREEMENT SHALL BE THE RETURN OF THE PAID TOUR COST. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, MODERN ADVENTURE SHALL NOT BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, INCIDENTAL OR OTHER DAMAGES ARISING OUT OF THIS AGREEMENT, INCLUDING LOST PROFITS, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF MODERN ADVENTURE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY WAIVE ANY RIGHT YOU MAY HAVE TO RECOVER SUCH DAMAGES.

24. Severability and Headings

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. Titles and headings of this Agreement are for convenience only and shall not affect the construction of any provision of this Agreement.

25. Successors and Assigns

This agreement shall inure to the benefit of and be binding upon Modern Adventure and the Participant and their respective heirs, legal personal representatives, successors and assigns.

26. Updating of Terms and Conditions

Modern Adventure reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions.

27. Applicable Law and Choice of Forum

Any dispute arising out of this agreement, including all tort claims and any dispute relating to bookings, tours, or transactions made with Modern Adventure – whether such dispute arises in contract or in tort or otherwise – shall be resolved exclusively by the state and federal courts located in Portland, Oregon, and you agree to personal jurisdiction of those same courts. The laws of the State of Oregon, USA, govern this agreement.

28. Merger

This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.

Liability, Assumption of Risk & Indemnification

All travelers are required to accept Modern Adventure’s Liability Waiver, which is a legally binding agreement. Please read this carefully and be prepared to accept and acknowledge the waiver at the appropriate time, prior to your trip departure.

Acknowledgement and Assumption of Risks

I am voluntarily participating on the Tour, which will involve a variety of activities depending on my itinerary and the activities in which I elect to participate, including but not limited to: sightseeing, classes, demonstrations, tastings, guided tours, walking, hiking, swimming in various bodies of water such as rivers and lakes, nature walks, encounters with wild fauna and flora, and/or other outdoor activities or sports (collectively, “Activities”). I understand that this list is not exhaustive of all Activities that may be made available to me and that I may decide to participate in. I also acknowledge that I am voluntarily participating on the Tour with knowledge that travel involves numerous risks and dangers including, but not limited to, the following: dangers and risks inherent in Activities; negligence by Modern Adventure and/or its suppliers and local operators in the conduct or arrangement of the Tour in any respect from inception to completion; emotional trauma; disfigurement, temporary or permanent disability, including paralysis; death; muscle strains, pulls, tears, broken bones, and shin splints; forces of nature; civil unrest and war; terrorism; roads, trails, hotels, vehicles, boats or other means of conveyance which are not operated or maintained at standards common in my country; crossing roadways and entering/exiting vehicles; the hazards of traveling in remote, unsafe or politically unstable areas or under unsafe conditions; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies; the adequacy of medical attention once provided; physical exertion for which I am not prepared; transportation failures; equipment failures, malfunctions or deficiencies; contact with wild animals whether on foot or in vehicles; social or labor unrest; consumption of alcoholic beverages; stolen, lost or misplaced luggage or property; theft or break-ins into vehicles, lodging or elsewhere; mechanical or construction failures or difficulties; diseases; epidemics; bites or stings from insects or pests; local laws; climatic conditions; abnormal conditions or developments; negligence by third-party service providers; financial default of any third party suppliers; and any actions, omissions or conditions outside of Modern Adventure’s control not mentioned herein. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the Tour provided by Modern Adventure. Furthermore, guides/ instructors/facilitators have difficult jobs to perform involving judgment of the weather, the elements, the terrain, and other aspects of the Tour. They must also make judgments when providing warnings or instructions. They seek safety, but they are not infallible and may misjudge the weather or other environmental conditions. I acknowledge that these are some, but not all, of the inherent and acquired risks associated with the activities performed on a Modern Adventure tour. A complete listing of inherent and acquired risks is not possible. I expressly agree to be responsible for my own welfare and fully assume all of the above risks, as well as all other risks set forth in this agreement, both known and unknown, voluntarily and knowingly, to the fullest extent permitted by law. If signed on behalf of a Minor, I have discussed the travel risks with the Minor, and he or she wishes to participate in the Tour nevertheless.

Medical Certification

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the Tour, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in the Tour, or else I am willing to assume the risk of and bear the costs that may result, directly or indirectly, from any such condition.

Waiver of Liability, Release, Indemnification, and Covenant Not to Sue

To the fullest extent permitted by law, I, an adult traveler, or as parent or legal guardian of the Minor, for myself, the Minor, my heirs, legal and personal representatives, next of kin, including my spouse, successors and assigns (individually and collectively, “Releasors”), expressly RELEASE, WAIVE, FOREVER DISCHARGE, HOLD HARMLESS AND COVENANT NOT TO SUE Modern Adventure, its owners, shareholders, officers, employees, directors, representatives, volunteers, guides, local operators and suppliers, successors and assigns (individually and together, “Released Parties”) from and against any and all liability, claims, causes of action, demands, costs, damages, losses or suits of any and every kind which I or the Minor now have or may later have against the Released Parties arising out of, relating to, or in connection with the Tour arranged through or provided by Modern Adventure whether arising from the Released Parties’ negligence or otherwise. In addition, I agree to fully indemnify (that is protect and defend, and satisfy claims against) and hold harmless each Released Party from any and all claims, actions, suits and demands (including all reasonable attorney’s fees and costs incurred by the Released Party) initiated by a third party and arising from, attributable to or related to my or the Minor’s negligent or intentional actions or inactions, whether arising from the Released Parties’ negligence or otherwise, occurring during the trip. I AGREE THAT THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, all members of my family and all minors traveling with me or on whose behalf I am signing this agreement, including the Minor (collectively encompassed by the term “their” in this paragraph), my and their heirs, as well as my and their next of kin, successors, assigns, and legal and personal representatives. It is my intention to fully assume all risks associated with the Tour and to release the Released Parties from any and all liability to the maximum extent permitted by law.
